What is a patent?

A patent is a document issued by the state to protect a novel invention or product design that has never been disclosed before. It grants the patent holder the exclusive right to manufacture, use, sell, or import the invention.

Once protected, others cannot copy or commercially use the invention without permission. Infringement can be prosecuted according to law.

The duration of protection depends on the type of patent, ranging from 6 years for utility models to 20 years for invention patents.

Types of patents

There are three types of patents in Thailand.

Things to know before submitting.

What types of inventions cannot be patented?

The invention must meet three criteria: novelty, inventive step, and industrial applicability. Our team will review it before submission to reduce the risk of rejection.

Absolutely forbidden characteristics

  • Microorganisms and any naturally occurring components of microorganisms.
  • Scientific and mathematical laws and theories.
  • Information systems for the operation of computers (computer programs).
  • Methods of diagnosing, treating, or curing human and animal diseases.
  • Inventions that are contrary to public order, morality, health, or welfare.

Things to watch out for before submitting.

  • Previously publicly disclosed work, such as publications in articles or sales.
  • Work already appearing in a patent or other previously filed patent document.
  • Purely a concept or theory that cannot yet be produced or used in practice.
  • Discovery of something already existing in nature without any additional invention.
  • A purely business methodology without any technical aspects involved.
