What is a trademark?

A symbol that says "This is mine."

A trademark is a symbol used to identify a manufacturer or service provider for a product or service. It may be a name, logo, slogan, shape, or specific color.

Once registered, you have the exclusive right to use that mark for the specified product/service and can sue anyone who imitates or infringes on your rights.

What types of trademarks are registered?

  • National flags, national emblems, or symbols of states and international organizations.
  • Symbols that are contrary to public order or good morals.
  • Symbols that are identical to or resemble the King or members of the Royal Family.
  • Symbols of government agencies, such as the Red Cross or the Thai Red Cross Society.

Characteristics that cannot be recorded.

  • Trademarks that lack distinctiveness, such as generic words or product descriptions.
  • Trademarks that are identical or similar to registered trademarks.
  • Symbols that could be confused with the products of other well-known companies.
  • Names, surnames, or images of other individuals without their consent.
  • Trademarks that mislead about the origin or characteristics of a product.

Search the Intellectual Property Department’s database to check if similar or identical trademarks already exist, reducing the risk of rejection.

Prepare images of the trademark, company documents, and specify the type of product/service (Nice Classification) you wish to protect.

Submit a registration application.

Submit an application to the Department of Intellectual Property and pay the fees according to the number of product types seeking protection.

Apply online or walk-in.

Inspection by the registrar.

Officials verify that the mark meets the criteria and is not already registered. If there are any deficiencies, the team will correct them immediately.

It takes approximately 12–18 months.

90-day advertising announcement.

Once the application has been approved, the trademark will be publicly advertised for 90 days to allow others to object. If there are no objections, the process will continue.

Receive a trademark registration certificate along with instructions for renewal every 10 years.

10-year coverage, renewable indefinitely.

Products/services are divided into 45 categories (Nice Classification).

The type of protection you wish to receive must be correctly specified. Protection is only provided for the type you are applying for. The more completely you specify, the greater the protection you will receive.

Important: If you register a product under category 30 (food) but not category 43 (restaurant), others may use the same name for your restaurant. Our team will help analyze which registration categories are most suitable for your business.
